These Terms and Conditions ("Terms") govern the purchase of products from FlitePal Ltd. ("FlitePal", "we", "us", "our") through the official FlitePal Ltd. website or through any distributor listed on the FlitePal Ltd. website. By placing an order with FlitePal Ltd. or with such a distributor, the buyer ("you", "the buyer") agrees to be bound by these Terms.

2. Definitions
For the purposes of these Terms:
- "Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession.
- "Business Customer" means a buyer purchasing products in connection with their trade, business, craft, or profession.
- "Product" means any product offered for sale by FlitePal Ltd. through the official FlitePal Ltd. website.
- "Product Documentation" means the applicable product datasheets, installation instructions, technical specifications, and other documentation supplied or made available by FlitePal Ltd.
3. Orders and Contract Formation
Product information displayed on the FlitePal Ltd. website, including prices, specifications, availability, images, and descriptions, is provided for information purposes and does not constitute a binding offer where otherwise required by applicable law.
An order placed through the website constitutes an offer by the buyer to purchase the selected Product(s). An automated acknowledgement confirming receipt of an order does not necessarily constitute acceptance of the order.
A sales contract is formed when FlitePal Ltd. expressly accepts the order or dispatches the Product(s), unless otherwise required by applicable law.
FlitePal Ltd. reserves the right to decline or cancel an order where permitted by applicable law, including in cases of obvious pricing or product-description errors, unavailable products, suspected fraudulent activity, or other circumstances preventing fulfilment of the order. If payment has already been made for an order that FlitePal Ltd. cancels, the amount paid for the cancelled order will be refunded.
4. Product Information and Intended Use
Product images, drawings, dimensions, colours, specifications, and other technical information are provided to describe the Products as accurately as reasonably possible. Minor changes that do not materially affect the Product's conformity, functionality, or intended use may be made from time to time.
The buyer is responsible for determining whether a Product is suitable for the buyer's intended application, except where FlitePal Ltd. has expressly confirmed suitability for a specific application in writing.
Unless expressly stated otherwise in the applicable Product Documentation, FlitePal Products are intended for flight simulation, hobby, training, or other applications specifically described by FlitePal Ltd. Products are not designed, certified, or approved for use in real aircraft, safety-critical systems, medical devices, life-support systems, or other applications where Product failure could reasonably result in personal injury, death, or significant property damage.
5. Prices, Payment and Delivery
Prices, applicable taxes, delivery charges, and available payment methods are displayed during the ordering process. The total amount payable by the buyer will be shown before the order is placed, as required by applicable law.
Estimated delivery times are provided in good faith and may vary depending on product availability, destination, carrier, customs procedures, and other circumstances outside FlitePal Ltd.'s reasonable control.
For deliveries outside the European Union, the buyer may be responsible for import duties, customs charges, taxes, or other fees imposed by the destination country unless otherwise stated at the time of purchase.
6. Right of Withdrawal (EU Consumers)
If you are a Consumer purchasing from within the European Union through a distance sales contract, you generally have the right to withdraw from your purchase within 14 calendar days of receiving the Product, without giving any reason, subject to the exceptions provided by applicable law.
- To exercise this right, you must notify FlitePal Ltd. of your decision to withdraw before the 14-day period expires. You may use any clear statement communicating your decision to withdraw.
- You must return the Product without undue delay and no later than 14 days after communicating your decision to withdraw, unless otherwise required by applicable law.
- You are responsible for the direct cost of returning the Product, unless otherwise stated or required by applicable law.
- You may be liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning.
- Upon a valid withdrawal, FlitePal Ltd. will reimburse all payments received from you, including the cost of the least expensive standard delivery option offered by FlitePal Ltd., without undue delay and no later than 14 days after being informed of your decision to withdraw.
- FlitePal Ltd. may withhold reimbursement until the returned Product has been received or until you provide evidence that you have sent the Product back, whichever occurs first.
- Where permitted by applicable law, the right of withdrawal does not apply to goods made to the Consumer's specifications or clearly personalised goods.
7. Statutory Consumer Rights and Product Warranty
Nothing in these Terms limits or excludes any mandatory statutory rights or remedies available to Consumers under applicable law.
Consumers may have statutory rights and remedies in relation to Products that do not conform to the sales contract. These rights exist independently of any commercial warranty offered by FlitePal Ltd.
Unless otherwise stated on the relevant Product listing or in the applicable Product Documentation, FlitePal Ltd. provides a commercial warranty of 2 years from the date of delivery. Where different or additional warranty terms are expressly provided for a particular Product, they will be stated on the relevant Product listing or in the applicable Product Documentation. A commercial warranty does not replace or restrict any mandatory statutory rights available to Consumers.
FlitePal Ltd. shall not be responsible for defects, damage, or failures resulting from:
- Disassembly, modification, or repair not authorised by FlitePal Ltd.
- Misuse or use outside the intended purpose of the Product.
- Operation outside the environmental or operating conditions specified in the applicable Product Documentation.
- Failure to follow applicable installation, operating, or maintenance instructions.
- Use with incompatible components, equipment, power supplies, or other systems.
- Mechanical failure or part damage resulting from excessive force applied to the threaded panel-mount bushing, including tightening beyond the torque specification stated in the applicable Product Documentation.
The exclusions above apply only to the extent that the relevant defect, damage, or failure results from the circumstances described and do not affect any statutory rights that cannot lawfully be excluded or limited.
8. Product Installation and Usage
The applicable Product Documentation and datasheet form an important part of the information relating to the Product and should be reviewed before installation and use.
The buyer is responsible for installing and operating the Product in accordance with the applicable Product Documentation and for ensuring that the Product is used within its specified electrical, mechanical, environmental, and operating limits.
Product Documentation is provided as a downloadable PDF file. A printed copy may be included with the shipment upon the buyer's specific request and may be subject to additional cost or lead time.
9. Limitation of Liability
Except as expressly provided in these Terms and to the extent permitted by applicable law, FlitePal Ltd. does not provide any contractual warranty or guarantee other than those expressly stated for the relevant Product. Nothing in these Terms affects any mandatory statutory rights or remedies available to Consumers.
To the maximum extent permitted by applicable law, FlitePal Ltd. shall not be liable for indirect or consequential losses, including loss of profit, loss of business, loss of data, or other financial loss arising from the use of, or inability to use, a Product.
Products are designed to operate within the environmental and operating conditions specified in the applicable Product Documentation. Operation outside those conditions, including excessive heat, moisture, inadequate ventilation, improper installation, unauthorised modification, or use with incompatible components, may result in reduced performance, damage, or premature failure. FlitePal Ltd. shall not be responsible for damage or failure resulting from such use, except where liability cannot lawfully be excluded or limited.
FlitePal Ltd. shall not be liable for damage or loss caused by the buyer's failure to follow applicable Product Documentation, improper installation, misuse, unauthorised modification, or use of a Product for an application for which it was not designed, except to the extent that such limitation is prohibited by applicable law.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Bulgaria or the European Union, including statutory rights and remedies available to Consumers.
10. Export and Import Compliance
Products sold by FlitePal Ltd. may be subject to import, export, customs, sanctions, licensing, safety, technical, or other regulatory requirements in certain countries or territories.
The buyer is responsible for determining whether the import, export, ownership, installation, and use of the purchased Product(s) is permitted in the buyer's jurisdiction and for complying with all applicable customs, import, export, sanctions, licensing, safety, and other regulatory requirements.
11. Language
Unless otherwise agreed by FlitePal Ltd., Product Documentation, technical documentation, customer support, and correspondence are provided in English.
12. Intellectual Property
All intellectual property rights in FlitePal Ltd. Products, designs, trademarks, product documentation, photographs, graphics, and other website content remain the property of FlitePal Ltd. or its licensors.
Customers may use Product Documentation for personal or internal business purposes related to the installation and use of FlitePal Products. No content may be reproduced, modified, published, or commercially distributed without prior written permission from FlitePal Ltd., except where permitted by applicable law.
13. Changes to Terms and Documentation
FlitePal Ltd. may update these Terms, Product Documentation, datasheets, and other related documents from time to time. Changes to these Terms will apply prospectively and will not affect orders already accepted, unless required by applicable law or expressly agreed otherwise.
The applicable version of the Product Documentation for a purchased Product will generally be the version identified or made available at the time of purchase, subject to corrections, safety updates, or other changes required by applicable law.
14. Applicable Law
These Terms and any contractual relationship between you and FlitePal Ltd. shall be governed by the laws of Bulgaria.
If you are a Consumer habitually resident in another country, this choice of law does not deprive you of any mandatory consumer protection provided by the law that would apply in the absence of such choice.
15. Disputes
Any dispute arising out of or relating to these Terms or a contract between you and FlitePal Ltd. shall be subject to the jurisdiction of the competent courts in accordance with applicable law.
Where permitted by applicable law, disputes with Business Customers shall be subject to the exclusive jurisdiction of the competent courts of Bulgaria.
16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
